Bids & RFP’s

The California Uniform Public Construction Cost Accounting Commission is under the umbrella of the California Uniform Public Construction Cost Accounting Act (CUPCCAA) and provides for alternative bidding procedures when an agency performs public project work by contract.

  • Public projects of $75,000 or less may be performed by negotiated contract or by purchase order per PCC22032(a).
  • Public projects of $220,000 or less may be let to contract by the informal bidding procedures per PCC22032(b). 
  • Public projects of more than $220,000 shall be let to contract by formal bidding procedures per PCC22032(c).
  • If all bids received are in excess of two hundred thousand dollars ($220,000), the governing body of the public agency may, by adoption of a resolution by a four-fifths vote, award the contract, at two hundred twelve thousand five hundred dollars ($235,000) or less, to the lowest responsible bidder, if it determines the cost estimate of the public agency was reasonable per PCC22034.

 

Contractor Prequalification

California school districts may require contractors to submit a standardized questionnaire and financial statements to determine if they’re qualified to bid. Contractors must declare, under penalty of perjury, that submitted information is true. Submitted questionnaires and financial statements are not public records and shall not be open to the public.

Public Contract Code 20111.5 enables districts to require prime contractors to be prequalified prior to accepting bids.  

Public Contract Code 20111.6 requires the district to do so for certain projects. This applies to prime contractors and MEP sub-contractors with the following licenses:

  • General Contractors (A and B)
  • Mechanical, Electrical and Plumbing subcontractors (C-4, C-7, C-10, C-16, C-20, C-34, C-36, C-38, C-42, C-43, and C-46)

CUPCCAA Program

Open Enrollment period for FUSD’s CUPCCAA Program for this calendar year begins December 1, and is open all year around.

The California Uniform Public Construction Cost Accounting Act (CUPCCAA) prequalification timeline are:

  • Applications must be submitted at least 10 business days before the bid opening date.
  • Applications must be approved at least 5 business days before the bid opening date.
  • Prequalification approval is valid for one calendar year from the date of qualification.

Per California Public Contract Code Section 22032, any Public Works project that is estimated to be below $220,000 is subject to the informal bidding procedures set forth by CUPCCAA. All trades categories are subject to informal bidding procedures. Contractors interested in being listed as an eligible contractor on FUSD’s informal bid list must:

  • Have a current license and are subject to verification through the CA Contractor’s State License Board;
  • Comply with *SB854 (Information on SB854 can be found at the following website: http://www.dir.ca.gov/Public-Works/Contractors.html) and;
  • Enroll using the FUSD CUPCCAA Contractor Application and complete the enrollment process.
  • SB854 requires DIR registration before prequalification application can be processed

In accordance with the 2016 State of California Uniform Public Construction Cost Accounting Act (CUPCCAA), the Fremont Unified School District is inviting all interested licensed Contractors to submit their company information for inclusion in the District’s Informal Bid List for Construction Projects under $220,000 for Calendar Year 2026.

Licensed Contractors interested in registering for the District’s CUPCCAA Bidder’s List must first complete and submit the correct information in the FUSD CUPCCAA Contractor Application.

Project Stabilization Agreement

The Project Stabilization Agreement (PSA) is a collaborative agreement between Fremont Unified School District, contractors, and labor organizations that sets clear standards for labor, safety, and project management. It helps ensure construction projects are completed efficiently, on time, and with high-quality workmanship, while supporting local hiring and fair labor practices.
